Terms of Service

These Terms of Service (“Terms”) govern the use of services provided by archKATect LLC (“we,” “us,” or “our”). By accessing our website or engaging with our services, you agree to be bound by these Terms. If you do not agree, you must not use our services.
1. Services archKATect LLC provides custom services in the areas of:
- Web design and development
- Branding and graphic design
- Digital marketing (SEO, content, PPC, social media)
- Strategy consulting and audits
Each engagement will be outlined in a written proposal, scope of work, or invoice. We reserve the right to decline any project that does not align with our values, capabilities, or capacity.
2. Payment Terms
- All fees are in U.S. Dollars (USD).
- Invoices are payable upon receipt unless stated otherwise.
- A 3% processing fee applies to all credit card payments.
- Late payments may incur a 2% monthly fee or result in project suspension.
- archKATect reserves the right to withhold or pause deliverables for accounts with outstanding balances.
3. Refund Policy Refunds are governed by our separate Refund Policy, available at: https://archkatect.com/refund-policy
4. Client Responsibilities You agree to:
- Provide timely feedback, assets, and approvals
- Respond to communications within reasonable timeframes
- Avoid project delays caused by inactivity or non-responsiveness
archKATect is not liable for delays due to client inaction.
5. Ownership and Intellectual Property
- All deliverables remain the property of archKATect until full payment is received.
- Upon payment, you are granted a non-exclusive, non-transferable license to use final deliverables for their intended purpose.
- We reserve the right to showcase completed work in our portfolio unless otherwise agreed in writing.
- Third-party tools, fonts, templates, or licensed content remain property of their respective owners.
6. Confidentiality We will treat any confidential information you share with us with care and discretion. Confidential data will not be shared or used outside the scope of your project without written permission.
7. Limitation of Liability To the maximum extent permitted by law, archKATect LLC shall not be liable for indirect, incidental, or consequential damages, including loss of business, data, or profits. Our total liability is limited to the fees paid for the specific services in dispute.
8. Governing Law These Terms are governed by the laws of the State of Nevada, United States. Any legal action or proceeding will be brought in the courts of Clark County, Nevada.
9. Changes to Terms We may update these Terms periodically. Any updates will be posted to our website. Continued use of our services after changes constitutes acceptance of the new terms.
